Ratio Decidendi

Regulation No 859/2003 does not apply to third-country nationals lawfully resident in an EU Member State and working in Switzerland because it is not among the Community acts listed in the EU-Switzerland Agreement. Therefore, there is no obligation on the Member State of residence to apply Regulations No 1408/71 and No 574/72. The refusal to grant child allowance under national law is lawful even if the children are EU citizens, provided statutory conditions are not met.
