Ratio Decidendi

The domestic courts failed to distinguish between statements of fact and value judgments, did not perform the required balancing exercise between the applicant's freedom of expression and the Governor's right to reputation, and did not provide relevant and sufficient reasons for the interference. Therefore, the interference with the applicant's Article 10 rights was not necessary in a democratic society, resulting in a violation of the Convention.
