Ratio Decidendi

A person with a contract for a position of trust may be regarded as an 'employee' under Directive 2001/23 if protected as such under national law and holding a contract of employment at the date of transfer. Directive 2001/23 precludes national legislation requiring, in the event of a qualifying transfer to a municipality, that employees undergo a public competitive selection procedure and enter a new employment relationship, as this undermines the protection guaranteed by the directive.
