A person retains the status of 'employed person' under Regulation No 1408/71 during unpaid parental leave if covered by any branch of the social security system. Where both the State of employment and State of residence provide entitlement to family benefits, the State of employment is responsible unless a parent works in the State of residence, in which case the State of residence is responsible and the State of employment's obligation is suspended up to the amount of the benefit provided by the State of residence.
