Ratio Decidendi

The domestic courts' repeated examination of ASITO's claims, after final judgments in favor of the applicants, deprived those judgments of effect and violated the principle of legal certainty under Article 6 § 1. The applicants' entitlement to annuity pensions constituted possessions, and the subsequent judgments in favor of ASITO interfered with their peaceful enjoyment of those possessions, violating Article 1 of Protocol No. 1. The requirements of Article 13 were absorbed by Article 6 § 1 in this context.
