Ratio Decidendi

Article 7(2) of Directive 2000/78, read in light of the UN Convention and the Charter, allows national legislation to confer specific advance protection against dismissal on employees with certain disabilities but not on civil servants with the same disabilities, unless this results in an infringement of the principle of equal treatment. It is for the national court to determine, based on all relevant national rules and the purpose of the protection, whether such an infringement exists. If discrimination is found, EU law requires that the protection be extended to civil servants with disabilities.
