Ratio Decidendi

The applicant was in a vulnerable position due to alcoholism and lack of legal assistance during initial police questioning. Her confession, made without a lawyer, was used for her conviction. There was no clear and unequivocal waiver of her right to legal assistance. The subsequent legal representation did not cure the initial defect. Therefore, there was a breach of Article 6 § 1 in conjunction with Article 6 § 3(c) of the Convention.

Orders

  • Respondent State to pay applicant EUR 2,000 in respect of non-pecuniary damage within three months, convertible to Polish zlotys at settlement date exchange rate, plus any tax chargeable.
  • From expiry of three months until settlement, simple interest at the marginal lending rate of the European Central Bank plus three percentage points.
