Procedural Posture

Application Under Article 34 of the European Convention on Human Rights / Judgment on Admissibility and Merits

  1. 1 Whether the length of criminal proceedings against the applicant was excessive under Article 6 § 1 of the Convention
  2. 2 Whether there was an effective domestic remedy for excessive length of proceedings as required by Article 13 of the Convention

Ratio Decidendi

The Court found that the length of the proceedings (approximately four years and eleven months for two levels of jurisdiction and six instances) did not violate the reasonable time requirement under Article 6 § 1, as there were no undue periods of inactivity and the overall length was not unreasonable. However, the Court found a violation of Article 13 because there was no effective domestic remedy for the applicant to challenge the length of proceedings.

Court Disposition

Application admissible; no violation of Article 6 § 1; violation of Article 13; partial award of costs and expenses; remainder of claim dismissed.
