Procedural Posture

EU Trademark Opposition Appeal / Judgment on Appeal From EUIPO Board of Appeal

  1. 1 Whether the Board of Appeal erred in finding no likelihood of confusion between the marks MULTIPHARMA and MUNDIPHARMA under Article 8(1)(b) of Regulation (EC) No 207/2009.

Ratio Decidendi

The Board of Appeal erred in finding a clear conceptual difference between the marks; the visual and phonetic similarities are high and not neutralized by conceptual differences. The goods and services are partially identical or similar. Therefore, there is a likelihood of confusion under Article 8(1)(b) of Regulation (EC) No 207/2009, and the Board of Appeal's decision must be annulled.

Court Disposition

Appeal allowed; Board of Appeal decision annulled.

Orders
