National courts, in public-interest actions brought by designated bodies, must assess the unfairness of unilateral amendment clauses in consumer contracts under Article 3(1) and (3) of Directive 93/13/EEC, considering whether the method and reasons for fee changes are clearly set out and whether consumers have a right to terminate. A declaration of invalidity of such terms in collective actions must have effect for all affected consumers, including those not party to the proceedings, and courts must apply all legal consequences under national law to ensure consumers are not bound by unfair terms.
