  1. 1 Whether national law allowing indefinite retention (until death) of personal, biometric, and genetic data of persons convicted of intentional public prosecution offences, including after rehabilitation, without right to erasure or limitation, is compatible with Directive (EU) 2016/680 and the Charter of Fundamental Rights of the EU.

Ratio Decidendi

A national law that provides for the retention by police authorities of personal, biometric, and genetic data of persons convicted of intentional public prosecution offences until their death, including after rehabilitation, without regular review of necessity or the right to erasure or limitation when retention is no longer necessary, is contrary to Directive (EU) 2016/680 and the Charter of Fundamental Rights of the EU. Such a regime is not proportionate, fails to ensure data minimization and storage limitation, and does not provide appropriate safeguards for sensitive data.
