Procedural Posture

Application to the European Court of Human Rights (echr) / Judgment After Referral by French Government and Commission Report

  1. 1 Whether the lack of a public hearing before the Ile-de-France regional council and the disciplinary section of the National Council of the ordre des médecins violated Article 6 § 1 of the Convention
  2. 2 Whether the composition and connections of the disciplinary bodies violated the requirement of impartiality under Article 6 § 1

Ratio Decidendi

The Court found that the applicants' right to a public hearing was violated because the relevant French law expressly excluded public hearings before the disciplinary bodies, and an appeal to the Conseil d’Etat would not have been an adequate or effective remedy. The Court also found a violation of the requirement of impartiality due to the structural connections between the disciplinary bodies and competitors of SOS Médecins, which objectively justified the applicants’ fears of bias.

Court Disposition

Violation of Article 6 § 1 found unanimously.

Orders

  • Respondent State to pay applicants specified sums for costs and expenses.
  • No award for pecuniary or non-pecuniary damages; judgment constitutes sufficient just satisfaction.
