Directives 81/851/EEC and 81/852/EEC lay down exhaustive and precise requirements for marketing authorisation of veterinary medicinal products. Competent authorities may not require information or impose conditions beyond those expressly provided, except where such information is the only reliable means to obtain particulars required by the Directives. The principle of proportionality is not infringed by the requirements of the Directives themselves. Article 40 does not require reasons for requests for further information under Article 9(3). Member States are liable for damages caused by breaches of these Directives if the rule infringed confers rights, the breach is sufficiently serious,...
