Ratio Decidendi

The Court held that the Commission was entitled to attribute the cartel conduct of KNP Vouwkarton and Badische to the applicant due to direct involvement of its management and lack of measures to prevent infringement. The duration of participation was correctly assessed as extending to April 1991, as the applicant continued to benefit from cartel conduct. The fine calculation was generally correct, but the Commission erred by using Badische's 1989 turnover instead of 1990, and by applying the ringleader rate to the entire period rather than only the period of PWG membership. The fine was reduced accordingly.
