Procedural Posture

Reference for a Preliminary Ruling / Judgment on Preliminary Reference

  1. 1 Whether Belgian health inspection measures on imported fish constitute measures having equivalent effect to quantitative restrictions under Article 30 EEC Treaty.
  2. 2 Whether such measures are justified under Article 36 EEC Treaty for public health protection.
  3. 3 Whether inspection levies imposed on imported fish are charges having equivalent effect to customs duties under Articles 9, 12, and 13 EEC Treaty or internal taxation under Article 95.

Ratio Decidendi

In the absence of harmonized Community rules, Member States may impose health controls on imported fish, but any detailed implementing rules that exceed what is necessary and hinder intra-Community trade are prohibited under Articles 30 and 36 EEC. Inspection levies imposed on imported fish, determined by criteria not comparable to those for domestic products and without objective justification, constitute charges having equivalent effect to customs duties and are prohibited by Articles 9, 12, and 13 EEC.

Court Disposition

Preliminary ruling issued; national court to apply ruling to facts.
