EU law (Article 29 of Regulation 575/2013, Article 10 of Delegated Regulation 241/2014, Articles 16 and 17 of the Charter) does not preclude national legislation prohibiting refusal of redemption of capital instruments by cooperative banks but allowing deferral or limitation of redemption for an unlimited period, provided such limitations are necessary and proportionate to ensure prudential requirements. Similarly, Article 63 TFEU does not preclude an asset threshold for cooperative banks if justified by general interest objectives and proportionate.
