Providing radio/TV in spa bedrooms constitutes 'communication to the public' under Directive 2001/29/EC; national law exceptions disallowing remuneration to authors in such circumstances are contrary to the directive. National courts must interpret domestic law in conformity with the directive. A national monopoly for copyright collecting societies is not precluded by Article 102 TFEU or Article 16 of Directive 2006/123/EC, and is only precluded by Article 56 TFEU if not justified by overriding reasons of public interest and proportionality.
