Procedural Posture

EU Trade Mark Opposition Appeal / Judgment on Appeal From EUIPO Board of Appeal

  1. 1 Whether the Board of Appeal erred in finding a likelihood of confusion under Article 8(1)(b) of Regulation (EU) 2017/1001
  2. 2 Whether the Board of Appeal erred in assessing the distinctiveness and renown of the earlier mark
  3. 3 Whether the Board of Appeal failed to consider all relevant differences between the marks

Ratio Decidendi

The Board of Appeal erred in its assessment of visual similarity by failing to consider all relevant differences between the marks, including the presence of a base in the earlier mark and the number of animals. It also erred in its assessment of the renown and distinctiveness of the earlier mark by relying on evidence relating to different signs and not conducting a global assessment of all evidence. These errors affected the finding of likelihood of confusion. Therefore, the Board of Appeal's decision was annulled.

Court Disposition

Appeal allowed; Board of Appeal decision annulled.

Orders

  • The decision of the first Board of Appeal of EUIPO of 2 February 2021 (Case R 863/2020-1) is annulled.
  • EUIPO shall bear its own costs and half of the applicants' costs.
