A regulation adopted by a professional association such as the OTOC, which reserves a substantial part of the compulsory training market for itself and imposes discriminatory conditions on competitors, constitutes a decision of an association of undertakings under Article 101(1) TFEU. Legal requirements for compulsory training do not remove such rules from Article 101 TFEU where the association has discretion over the rules. The restrictions imposed go beyond what is necessary to guarantee service quality and are not justified under Article 101(3) or 106(2) TFEU.
