Ratio Decidendi

National legislation may impose preventive measures to avoid absconding on Union citizens and their family members during the period allowed to leave the host Member State after an expulsion decision on public policy grounds, provided such measures comply with Article 27 of Directive 2004/38 and are no less favourable than those for third-country nationals. However, national legislation cannot provide for a maximum detention period of eight months for Union citizens and their family members for the purpose of removal, identical to that for third-country nationals, as their situations are not comparable and such a period exceeds what is necessary to achieve the objective pursued.
