SGAE (Intellectual property) [2010] EUECJ C-467/08_O (11 May 2010)

The concept of 'fair compensation' in Article 5(2)(b) of Directive 2001/29/EC is an autonomous Community law concept requiring uniform interpretation and application across Member States, but Member States retain discretion to determine criteria and methods for implementation within the limits of EU law.
