The domestic courts violated Article 6 § 1 of the Convention by dismissing the applicant’s claim for salary arrears solely because he did not seek enforcement of the reinstatement judgment within the statutory time-limit, without considering that he was not in a position to observe the time-limit due to the delay in obtaining the certificate of finality. This impaired the essence of his right of access to court.
