Article 16(1) of Regulation (EC) No 261/2004 does not preclude national legislation empowering the national enforcement body to order an air carrier to pay compensation to a passenger for flight cancellation or long delay, provided that such legislation does not deprive either the passenger or the carrier of the right to bring proceedings before a national court to claim or challenge the compensation. Member States have procedural autonomy to coordinate administrative and judicial procedures.
