Ratio Decidendi

Article 14 of Directive 2006/123/EC precludes national legislation requiring certification bodies (SOAs) to have their registered office in national territory, as such a requirement is a prohibited restriction on freedom of establishment and cannot be justified under EU law. Certification activities of SOAs are not excluded from the scope of EU internal market freedoms by Article 51 TFEU.
