Procedural Posture

EU Trade Mark Invalidity Appeals (joined Cases T 101/15 and T 102/15) / Judgment on Appeal From EUIPO Board of Appeal Decisions

  1. 1 Whether the graphic representation and description of the contested colour per se marks meet the requirements of Article 4 and Article 7(1)(a) of Regulation No 207/2009
  2. 2 Whether the Board of Appeal infringed the principles of proportionality and equal treatment
  3. 3 Whether the principle of protection of legitimate expectations was breached

Ratio Decidendi

The Court held that the graphic representation and accompanying descriptions of the contested colour per se marks did not provide a systematic arrangement associating the colours in a predetermined and uniform way, as required by Article 4 and Article 7(1)(a) of Regulation No 207/2009 and the case-law (Heidelberger Bauchemie). The mere indication of proportions allowed for numerous different combinations, failing the required precision and uniformity. The Court further found no breach of the principles of proportionality, equal treatment, or legitimate expectations.
