Preliminary Ruling (article 234 Ec) / Reference From National Court (tribunal Judicial Da Comarca De Ponta Delgada)

  1. 1 Whether refining raw beet sugar into white sugar constitutes processing under Article 8 of Regulation No 1600/92
  2. 2 Definition of traditional shipments under Article 8 of Regulation No 1600/92
  3. 3 Whether Community law precludes shipment to mainland Portugal of white sugar produced in the Azores from locally harvested sugarbeet with Community aid

Ratio Decidendi

Refining raw beet sugar into white sugar is processing within Article 8 of Regulation No 1600/92.
