Ratio Decidendi

The Board of Appeal erred in finding that the services for providing food and drink, restaurant services, and coffee-shop services (Class 43) and cheese (Class 29) were dissimilar. There is a certain degree of similarity, albeit weak, due to their complementarity. This similarity required the Board to assess the likelihood of confusion, which it failed to do. Therefore, the contested decision must be annulled.
