The indefinite lease and rent control regime imposed a disproportionate and excessive burden on the applicants, depriving them of a fair return and lacking adequate procedural safeguards, thus violating Article 1 of Protocol No. 1. However, the difference in treatment between club landlords and commercial landlords was reasonably justified at this stage and did not violate Article 14 in conjunction with Article 1 of Protocol No. 1.
