Ratio Decidendi

The Advocate General opined that Article 17 of Directive 2019/790, while imposing monitoring and filtering obligations on online content-sharing service providers, contains sufficient safeguards to ensure that the impact on freedom of expression is minimised and a fair balance is maintained between the rights of rightholders and users. The limitation is provided for by law, respects the essence of the right, and is proportionate. Therefore, the provision is valid and the action should be dismissed.
