Procedural Posture

Application Under Article 34 of the European Convention on Human Rights / Judgment on Admissibility and Merits

  1. 1 Whether the applicant's conditions of detention violated Article 3 of the Convention
  2. 2 Whether the applicant was denied a fair trial under Article 6 §§ 1 and 3 (b) and (c)
  3. 3 Whether there was a lack of effective remedies under Article 13

Ratio Decidendi

The applicant's conditions of detention, specifically lack of personal space and aggravating factors such as poor lighting, ventilation, food, sanitary arrangements, and medical assistance, amounted to inhuman and degrading treatment in violation of Article 3. The Supreme Court's refusal to provide additional time for familiarisation with the case file and to ensure legal representation at the cassation hearing violated Article 6 §§ 1 and 3 (b) and (c). There was also a violation of Article 13 due to lack of effective remedies for the detention conditions. The refusal to provide certified copies of documents did not hinder the right of individual petition under Article 34.

Court Disposition

Complaints concerning conditions of detention, insufficient time and facilities for cassation appeal, lack of legal representation at cassation, and lack of effective remedies for detention conditions declared admissible and found to be violations; remainder of application inadmissible or rejected.
