The General Court found that the Board of Appeal erred in its assessment of the similarity between the marks, concluding that there is a medium phonetic and high conceptual similarity, and that, given the identity of the goods and the normal distinctiveness of the earlier mark, there is a likelihood of confusion under Article 8(1)(b) of Regulation No 207/2009. The decision of the Board of Appeal was annulled.
