Ratio Decidendi

Directive 77/93/EEC permits Member States to admit plants originating in a non-member country accompanied by a certificate issued in a non-member consignor country, provided the plants have been imported and remained in that country for sufficient time and conditions to enable proper checks, and are not subject to special requirements that can only be satisfied in their place of origin. The reasons for not obtaining a certificate in the country of origin are irrelevant to compliance.
