The Court found a violation of Article 6 § 1 due to excessive length of proceedings before the Düsseldorf Regional Court, which failed to exercise special diligence given the importance of the issues at stake. Regarding Article 8, the Court found no violation in the continued placement of the child with the foster family and partial withdrawal of custody rights, as these were justified and in line with expert recommendations. However, the exclusion of access rights was not convincingly justified, especially given the expert's view that contact was indispensable for the child's development, and thus constituted a violation of Article 8.
