Procedural Posture

Application Under Article 34 of the European Convention on Human Rights / Judgment on Striking Out Following Unilateral Declaration

  1. 1 Whether the destruction of applicants' property and subsequent treatment violated Articles 3, 6 § 1, 8, 13, and 14 of the Convention
  2. 2 Whether the Government's unilateral declaration and proposed measures provide adequate redress
  3. 3 Whether the case should be struck out under Article 37 § 1 (c) of the Convention

Ratio Decidendi

Given the Government's admission of violations, the proposed individual and general measures, and the existence of a final judgment in a similar case (Moldovan v. Romania), it is no longer justified to continue the examination of the application. The measures proposed provide effective redress, and respect for human rights does not require further examination. The case is therefore struck out under Article 37 § 1 (c) of the Convention.
