  1. 1 Whether national authorities may reduce EAFRD financial aid due to a calculation error before a formal Commission exclusion decision, in light of Article 40(3) of Regulation No 1698/2005, Article 58(1) of Regulation No 1306/2013, Article 310(5) TFEU, and the principles of legitimate expectations and legal certainty.

Ratio Decidendi

Article 40(3) of Regulation No 1698/2005 and Article 58(1) of Regulation No 1306/2013, read with Article 310(5) TFEU and the principles of legitimate expectations and legal certainty, do not preclude national authorities from reducing EAFRD financial aid due to a calculation error found by the Court of Auditors, even before the Commission formally excludes the excess from EU financing, as Member States are obligated to recover undue payments and cannot create legitimate expectations contrary to clear EU law.
