Ratio Decidendi

EU law does not preclude national legislation requiring the minimum grazing activity to be carried out by animals kept by the farmer, provided the legislation is proportionate and consistent with CAP objectives. The concept of 'active farmer' can include legal persons using loaned animals if they exercise sufficient control and perform the minimum activity. Submission of concession and loan-for-use contracts may constitute 'artificially created conditions' if both objective and subjective elements of abuse are present, to be determined by the national court.
