  1. 1 Whether, under Article 52(1)(b) of Regulation (EC) No 883/2004, non-contribution periods not exceeding one third of aggregated contribution periods (national and other Member States) must be taken into account for both the theoretical and actual amount of pension benefits, or only for the theoretical amount, or not at all.

Ratio Decidendi

Under Article 52(1)(b) of Regulation (EC) No 883/2004, non-contribution periods not exceeding one third of the aggregated contribution periods completed under national law and under the legislation of other Member States must be taken into account only for the purpose of determining the theoretical amount of the pension benefit (Article 52(1)(b)(i)), and not for the purpose of establishing the actual (pro rata) amount of the benefit (Article 52(1)(b)(ii)).
