Procedural Posture

Appeal / Opinion of Advocate General

  1. 1 Whether measures granted to Femern Landanlæg constitute State aid under Article 107(1) TFEU
  2. 2 Whether the market for operation and management of railway infrastructure in Denmark is open to competition
  3. 3 Admissibility of actions brought by ferry operators regarding State aid decisions

Ratio Decidendi

Appellants have standing only as interested parties to safeguard procedural rights under Article 108(2) TFEU, not to contest the merits of the decision regarding measures for Femern Landanlæg. The General Court did not err in finding that the measures for Femern Landanlæg and Femern are separate, with different purposes and beneficiaries, and that the market for operation and management of railway infrastructure in Denmark is not open to competition. The Commission's cross-appeals are inadmissible as no appeal lies against an implied decision on admissibility when the General Court rules on the merits.

Court Disposition

Dismissal of cross-appeals as inadmissible; rejection of first two grounds of main appeals regarding merits; recognition of appellants' standing only for procedural rights under Article 108(2) TFEU.
