Ratio Decidendi

The Court held that the Commission, by adopting the second sentence of Article 49(1) and point 10(B) of Annex IV of Regulation No 601/2012, broadened the definition of 'emissions' beyond what is provided in Article 3(b) of Directive 2003/87/EC. The provisions created an irrebuttable presumption that all CO2 transferred for PCC production is emitted, even if not released into the atmosphere, thus altering an essential element of the Directive and exceeding the Commission's implementing powers.
