Ratio Decidendi

The Hungarian legislation extinguishing usufructuary rights in agricultural land not created between close family members constitutes an unjustified, indirectly discriminatory restriction on the free movement of capital under Article 63 TFEU. The restriction disproportionately affects nationals of other Member States and cannot be justified by the objectives of preventing abuse, enforcing exchange control, or public interest in land use. The Charter of Fundamental Rights cannot be applied independently of the question of infringement of fundamental freedoms in this context.
