SIVU's payments before judgment were applied first to interest, not capital, as per Article 1254 of the French Civil Code and absent creditor consent. The contractual interest accrues from 31 May 1991, the date works ceased. The remaining debt after SIVU's payments was recalculated, and the operative part of the default judgment was set aside and replaced with an order for the recalculated sum and interest.
