Procedural Posture

Preliminary Ruling (renvoi Préjudiciel) / Final Judgment

  1. 1 Whether an action in summary proceedings (référé) relating to penalties under a public works contract falls within 'civil and commercial matters' under Article 1(1) of Regulation (EU) No 1215/2012
  2. 2 Whether a court of a Member State seized under Article 35 must decline jurisdiction if the court competent on the merits has already ruled on similar provisional measures
  3. 3 Whether the conditions for granting provisional measures under Article 35 are autonomous under EU law or subject to national law

Ratio Decidendi

An action in summary proceedings (référé) for penalties under a public works contract, even if the contracting authority is a public entity, falls within 'civil and commercial matters' under Article 1(1) of Regulation (EU) No 1215/2012 if the authority does not exercise public powers. Article 35 does not require a court to decline jurisdiction for provisional measures merely because the court competent on the merits has already ruled on similar measures. The conditions for granting such measures are determined by the law of the forum.
