Ratio Decidendi

Article 41 of Regulation (EC) No 1346/2000 fixes the maximum requirements for the content of the production of a claim in cross-border insolvency proceedings. It is sufficient that the date of birth of the claim can be deduced from the annexed documents; it need not be expressly stated in the declaration. The validity and consequences of incomplete declarations are governed by the law of the Member State where the main insolvency proceedings are opened (lex concursus).
