Ratio Decidendi

A national rule imposing stricter hourly advertising limits on pay-TV than on free-to-air broadcasters is compatible with EU law if it pursues, in a proportionate manner, the aim of protecting consumers as viewers against excessive advertising. However, if the rule's main aim is to ensure higher advertising revenue for free-to-air broadcasters without objective justification, it is incompatible with the general principle of equal treatment and Article 56 TFEU. It is for the national court to determine the primary aim of the rule.
