Procedural Posture

Application Under Article 34 of the European Convention on Human Rights / Judgment by the European Court of Human Rights (fourth Section)

  1. 1 Whether the applicant's inability to vote for candidates of choice in legislative and presidential elections at State level due to ethnic and territorial requirements constitutes discrimination under Article 14 of the Convention, Article 3 of Protocol No. 1, and Article 1 of Protocol No. 12.
  2. 2 Whether the exclusion of citizens not affiliated with constituent peoples from the House of Peoples and the Presidency is compatible with the Convention.

Ratio Decidendi

The Court found that the applicant's inability to vote for candidates of his choice in legislative and presidential elections at State level, due to the combination of ethnic and territorial requirements, constituted discrimination on grounds of ethnicity and residence. The current arrangements privilege constituent peoples and exclude citizens not affiliated with them, amplifying ethnic divisions and undermining the democratic character of elections. Such exclusion is not objectively justified in a democratic society and violates Article 1 of Protocol No. 12.

Court Disposition

Orders

  • Bosnia and Herzegovina must amend its Constitution and electoral legislation to eliminate discrimination based on ethnic affiliation in elections for the Presidency and the House of Peoples.
  • The judgment will become final as set out in Article 44 § 2 of the Convention.
