The first sentence of Article 11(6) of Regulation 1/2003 relieves national competition authorities of competence only where the Commission's proceedings concern the same alleged infringements, product/geographical market, and period. The ne bis in idem principle applies to competition law infringements but only precludes double proceedings/sanctions for the same conduct, offender, and legal interest, and does not apply where the authorities act on separate markets or where the national authority is relieved of competence under Article 11(6).
