Article 59 of the EEC Treaty precludes a Member State from requiring a credit institution already authorized in another Member State to obtain a further authorization to grant a mortgage loan within its territory, unless such authorization is required of all entities, is justified by public interest (such as consumer protection), is objectively necessary, and cannot be achieved by less restrictive means.
