Ratio Decidendi

The Board of Appeal erred in finding that the marks at issue were dissimilar. There is a weak but non-negligible visual and conceptual similarity between the marks due to the shared element of a red mug on a bed of coffee beans, which, although of low distinctiveness, is not negligible in the overall impression. The Board of Appeal should have proceeded to a global assessment of the likelihood of confusion. The decisions are annulled to that extent.
