Ratio Decidendi

Third-party proceedings between insurers based on multiple insurance are not subject to Section 3 of Title II of the Brussels Convention, as the special protection for the economically weaker party does not apply to relations between insurers. Article 6(2) of the Convention is applicable to such third-party proceedings, provided there is a sufficient connection between the original and third-party proceedings to ensure the choice of forum is not abusive.
