Article 49 TFEU does not preclude a national rule requiring, upon the expiry of a concession to occupy State-owned land and unless otherwise stipulated in the concession agreement, the immediate, uncompensated transfer to the State of fixed structures erected by the concessionaire, even if the concession is renewed, because such a rule applies equally to all operators, is inherent to the public domain, and any restrictive effects on establishment are too uncertain and indirect.
